Denmark Announces Updated Work Permit Rules

The updated work permit and salary assessment regulations in Denmark will take effect on October 1, 2024. To make sure their applications satisfy Danish criteria foreign employees and employers need to stay up to date on salary rules, work schedules and the most recent revenue figures.

Foreign nationals who want to live and work in Denmark need to be aware of any updates to the legislation, particularly about wage evaluations. Important SIRI Update:

An updated practice note for determining whether a proposed salary conforms with Danish wage regulations was produced by SIRI on September 27, 2024. These modifications impact both submitted and pending applications with a focus on important work schemes.

Inclusion of New Work Schemes: In light of recent modifications to Danish employment laws the practice note now addresses the Supplementary Pay Limit Scheme and the Fast-track Scheme’s supplementary pay limit track.

Affected Work Schemes:

The updated practice note covers a multitude of schemes, including:

  • Pay Limit Scheme.
  • Supplemental Pay Limit Scheme
  • Fast-track Scheme (5 tracks)
  • Researcher Scheme
  • Positive List for People with Higher Education.
  • Work permits for employees’ family members.

Explanation of Collective Agreements:

In situations where collective agreements are applicable SIRI will often not evaluate salaries. In contrast SIRI will evaluate salaries for employers who belong to an Employer’s organisation up to the point slightly above the standard pay limit.

Assessment of Alternative Employment Terms:

SIRI will review whether other significant aspects of employment meet Danish standards in addition to evaluating compensation.

Income Data and Application Closing Dates:

As of this week, SIRI has made updated income figures available to process work permit applications. This will begin on October 1, 2024. This salary information will be updated every three months starting on October 1, 2024 and the next update will be released on January 1, 2025.

Regarding Candidates:

SIRI will use income data from the second quarter of 2024 if you apply for a work permit and residence visa after September 30, 2024.

SIRI will assess your application based on wage data from the first quarter of 2024 if you applied between July 1 and September 30, 2024.

Increased Salary Threshold Effective October 2024:

In addition, Denmark will raise the pay standards for foreign workers as of October 1, 2024. To be qualified under the new regulations work permit applicants must make at least 10% more money than the current minimum level.
